Making or responding to an employment tribunal claim

Do you want to make a claim to an employment tribunal if you think someone has treated you unlawfully, such as your employer, a potential employer, or a trade union?

Unlawful treatment can include:

  • Unfair dismissal
  • Discrimination at work
  • Breach of contract
  • Unauthorised deductions from your pay.

About the Employment Tribunal:

The tribunal is independent of government, and it will listen to you (known as the claimant) and the person or organisation you are making a claim against (known as the respondent) before making a decision.

Making a claim:

You can make a claim:

  • For yourself, as the only user claiming
  • For yourself and others who’ve been treated in the same way
  • For someone else, if you’re acting as their representative.

Claims usually have to be made to the tribunal within three months of the user's employment ending or the problem occurring.

What you will need to make an online claim:

  • The names and addresses of all the users making the claim (the ‘claimants’)

  • The names and addresses of the respondents - this can be found in the relevant job offer letter, employment contract or payslips

  • The Acas early conciliation certificate numbers.

Responding to a claim:

You will be sent a letter from the tribunal if a claim has been made against you and conciliation has not worked.

Once you have received this letter, you will have 28 days to respond to the claim that has been made against you. In the instance you need more time, you can ask the tribunal. If however, you are late or do not respond, the tribunal could make a decision against you without a hearing.
